In September of 2001, a Dean’s memorandum (Memorandum 01-31) was sent to member and fee-paid schools on behalf of the Executive Committee to encourage member schools to adopt a general permission agreement for educational use of law review materials to provide a more efficient and systematic process for schools in preparing faculty course packs. It is the intention of the AALS to serve as a clearinghouse for all such agreements by having them available for review on the AALS website. As of this date, we have received responses from approximately 20 law schools.
In the previous memorandum, we suggested language for such an agreement for schools that had not already adopted an agreement. It is as follows:
Except where otherwise expressly provided, [the law school journal/review] and the author of each article, note, or comment in this issue of [the law school journal/review] grants permission to duplicate that article, note or comment for educational use, provided that (i) copies are distributed at or below cost; (ii) the author and [the law school journal/review] are identified, and (iii) proper notice of copyright is affixed to each copy.
We hope that more schools will participate in this effort by forwarding a copy of the school’s current agreement for inclusion on the AALS website. To enable us to process this quickly, we ask that you send it to us in electronic form to vmiles@aals.org
