Undocumented Immigrant Workers in the Global Economy: The Case of Hoffman Plastics

This panel will analyze the U.S. Supreme Court's recent decision in Hoffman Plastics Compounds v. NLRB, 122 S. Ct. 1275, decided on March 27, 2002, from employment, immigration, and civil rights perspectives. In this case, the Court held that the National Labor Relations Board could not award back pay to an undocumented immigrant worker, Jose Castro, even though the employer laid him (and others) off for union organizing activities protected by federal labor law. This decision has important implications for immigrant workers, many of who are people of color, in the emerging global labor economy. Panelists will critically analyze the decision from a variety of perspectives.
