Empirical Studies: How Do Discrimination Cases Fare in Court

Do plaintiffs fare worse in federal appellate job bias cases than in any other kind of civil case? Do plaintiffs in Americans with Disabilities Act (ADA) employment discrimination cases lose more often than nearly any other type of plaintiffs in trial courts? What methodology is needed to answer these questions, and what conclusions can be drawn from the answers? Professor Schwab, with Professors Theodore Eisenberg and Kevin Clermont, has analyzed data from the Administrative Office of the United States Courts. Professor Colker has examined all ADA appellate employment discrimination decisions available on Westlaw from 1992-1998, along with other data. Professors Schwab and Colker will explain their methodology, reveal their findings, and discuss their conclusions in this session.
