Comparative Law Approaches to Constitution Building

What is or should be the role of comparative law in constitution building? To what extent do constitutional reformers and decision-makers draw (or fail to draw) on foreign constitutional experience? How well or poorly drawn are cross-national comparisons in matters such as institutional design, fundamental rights, and court doctrine? What are the potential benefits and hazards of emulating, adapting, or ignoring foreign constitutional determinations? In this program, the panelists will describe, evaluate, and attempt to draw broader lessons from the use of comparative law in national constitution building experiences in a diverse group of nations, including China, Indonesia, Namibia, Palestine, South Africa and the successor states of the former Soviet Union.
