Legislative and Administrative Approaches to Police Misconduct and Accountability Issues

When scholars and teachers of criminal law and procedure and of constitutional law think about how to control police misconduct and achieve greater public accountability of police departments to the public, they often think first-and sometimes only-about how the U.S. Supreme Court might do more to tighten judicial oversight of police discretion, usually through using some form of exclusionary sanction. This avenue toward change and reform has proven remarkably unhelpful for at least fifteen to twenty years. The speakers on this panel will attempt to suggest that there are other, much more fruitful ways that one might approach these issues using the legislatively-created devices and the internal administrative rulemaking processes themselves, sometimes against a backdrop of significant public and political pressure. All of these panelists have had experience with both creating and using these legislative and administrative tools and approaches, and all have met with a surprising degree of success.
