The Osceola After 100 Years: Maritime Personal Injury Law in the U.S.

A century ago, the U.S. Supreme Court issued its decision in The Osceola, 189 U.S. 158 (1903), announcing four legal propositions that controlled personal injury claims by seaman at the time. The proposition established claims and defenses for a seaman's cause of action based on unseaworthiness of the vessel, maintenance and care and negligence by vessel's master or fellow crew members. On the 100th anniversary of the Court's decision, the four speakers contributing to this symposium will critically examine the original decision by the Court, Congress' response to the decision and its effect on remedies available to injured seaman, and later applications of the four propositions in maritime personal injury cases in both federal and state courts.
