Consumer protection statutes are generally based on liability rules, rather than property base protection. Violators are required to pay damages. Given the expense of pursuing legal remedies, the risk of insolvency, and the difficulty proving damages, liability based protection is likely to underprotect consumers. The panelists will discuss the possible benefits and costs of recasting consumer protection as property rather than liability based.
