The increasing popularity of the Internet has made it easier both to infringe intellectual property rights, and to be caught for such infringement. Not surprisingly, the number of infringement suits filed in the federal court system has increased substantially and there has thus been considerable incentive to turn to insurance to recoup the costs of litigation and damage awards. There are essentially two sources of insurance coverage for alleged infringement: the advertising clause of the Commercial General Liability Policy, and the very recently created "patent infringement" policies. At present, there is not a uniform approach to, or understanding of the issues. The panelists will assist us in appreciating this fascinating new area of insurance law as it unfolds.
