| Early this year the Ninth Circuit decided that the enforcement of Alaska housing laws prohibiting apartment owners from refusing to rent to unmarried couples infringed on Christian landlords' rights under the Free Exercise Clause of the First Amendment. Thomas v. Anchorage Equal Rights Commission, 165 F.3d 692 (Ninth Cir. 1999). At the time of this writing the United States Senate is scheduled to consider the Religious Liberty Protection Act that will address issues similar to those raised in Thomas. This panel will focus on how claims of religious liberty may conflict with a claim to be free from discrimination. Questions and defining the prerequisites and limits of those claims and doctrinal issues about how those claims can, or cannot, be accommodated will be addressed. |
